General Terms and Conditions (GTC)
1. Scope of Application
The following General Terms and Conditions (GTC) apply to all contracts concluded between [Benedikt H. Mehr Sadeh], hereinafter referred to as "Photographer," and the customer (via the website [www.benedikthmehrsadeh.com]). Deviating provisions are only valid if agreed upon in writing.
2. Conclusion of the Contract
The contract is concluded when the customer accepts the photographer's offer (on the website) or through a booking request followed by the photographer's confirmation via email or phone. The booking of a photo appointment is binding.
3. Description of Services
The photographer offers the following services:

4. Prices and Payment Terms
All prices are inclusive of the statutory value-added tax unless otherwise stated.
Payment methods: The customer can make the payment via [bank transfer, PayPal, cash, etc.].
Payment terms: A deposit of 50% is due upon conclusion of the contract, with the remaining balance to be paid no later than 7 days after the provision of services.
Cancellation policy: In case of cancellation, 50% of the order value will be charged as a cancellation fee.
5. Copyright and Usage Rights
The photographer retains all copyrights to the images. The customer is granted a simple, non-transferable right to use the images for private, commercial, or other purposes. Commercial use requires the explicit consent of the photographer.
The customer may use the images for the agreed purposes but is not permitted to distribute or sell the images to third parties without the photographer's consent.
6. Liability
The photographer is not liable for damages caused by unforeseeable events (e.g., force majeure). In case of loss or damage to photos, the photographer is only liable if the loss was caused by gross negligence or intent on the part of the photographer.
7. Data Protection
The photographer is committed to handling the customer's personal data in accordance with the General Data Protection Regulation (GDPR). Data will only be shared with third parties as necessary for the fulfillment of the contract (e.g., for photo editing or image delivery).
8. Right of Withdrawal
The customer has the right to withdraw from the contract within 14 days of conclusion without providing a reason. However, the right of withdrawal expires if the photographer has already begun the provision of services after the customer has explicitly agreed to this.
9. Delivery and Collection
The delivery of images varies depending on the type of order and will be discussed individually during a "getting-to-know-you" meeting.
The images will be provided via a download link.
10. Jurisdiction and Applicable Law
German law applies. The place of jurisdiction for any disputes arising from this contract is Germany, provided the customer is a merchant or a legal entity under public law.
11. Final Provisions
If any provision of these GTC is invalid, the remaining provisions shall remain unaffected. Changes to the GTC must be communicated to the customer in a timely manner before the conclusion of the contract.
